1. About these Terms
1.1 These Terms & Conditions ("Terms") form a binding agreement between you ("you", "your", "User") and Ackrolix Innovations Private Limited ("Puls-E", "we", "us", "our").
1.2 They govern your use of the Puls-E mobile application and any related website, mobile site, media channel or connected service (the "Platform") and the services available through it (the "Services").
1.3 These Terms are drafted in conformity with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines) Rules, the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, the Digital Personal Data Protection Act, 2023, and the GDPR where applicable. No physical or digital signature is required.
1.4 By clicking "I Agree", creating an Account, or using the Services, you accept these Terms, our Privacy Policy and our Cancellation & Refund Policy (together, the "Policies").
2. Eligibility
2.1 You must be at least 18 years old to use Puls-E. By accepting these Terms you represent that you are 18 or over.
2.2 You must also: (a) have the legal capacity to enter a binding contract; (b) hold only one Account, registered in your real name and accurate details; and (c) not be a person we have previously restricted from the Services.
2.3 Age verification. Because your date of birth is a required input to your Reading, we use it to verify eligibility. Accounts indicating an age under 18 will not be activated, and Accounts found to have supplied a false date of birth may be suspended and deleted under Clause 3 of the Privacy Policy.
2.4 If you do not meet these requirements, you must not use the Services.
3. Changes to these Terms
3.1 We may modify these Terms and introduce new policies. The current version supersedes all previous versions.
3.2 Material changes affecting your rights will be notified by email and in-app at least 7 days before taking effect.
3.3 Continued use after a change takes effect constitutes acceptance. If you do not accept a change, you may terminate your Account at any time under Clause 16.
4. Description of the Services — and their limits
Please read this clause carefully. It defines what Puls-E is and is not.
4.1 What we provide. Puls-E generates automated, AI-assisted, personalised informational readings based on your astrological birth data and, where you enable it, your reflections and app activity. This includes your day score, thirteen daily parameters, peak and risk windows, muhurat guidance, personality profile, compatibility readings, weekly and monthly pattern reports, and conversation with our assistant, Puls-e AI.
4.2 For self-reflection and entertainment only. The Services are intended to provide helpful, informative material relating to astrology and personal insight, for self-reflection and entertainment purposes only.
4.3 Not professional advice. Puls-E does not provide psychological, psychiatric, medical, health, legal, financial, investment or any other professional service. No Reading is professional advice. If you require such advice, consult an appropriately qualified professional.
4.4 Not a medical or mental-health service. The Anxiety, Overthinking, Mood and Decision-making indicators are reflective signals, not clinical measurements, diagnoses or assessments. Puls-E is not a medical device and must not be used to diagnose, treat, cure or prevent any condition.
4.5 Not a prediction of outcomes. Timing guidance — peak and risk windows, Rahu Kaal, Abhijit, muhurat and electional recommendations — is traditional astrological calculation. It is not a forecast of what will happen and carries no guarantee of any result.
4.6 Accuracy. We do not warrant that any Reading is accurate, complete, reliable or suitable for any purpose. Astrological interpretation is inherently subjective.
4.7 Your decisions are yours. You assume full responsibility for any action you take, or refrain from taking, on the basis of the Services. We expressly disclaim responsibility for any liability, loss or risk incurred directly or indirectly as a consequence of using the Services.
4.8 In an emergency. Puls-E is not an emergency service and is not monitored in real time. If you are in distress or danger, contact local emergency services, or in India Tele-MANAS 14416 or KIRAN 1800-599-0019.
4.9 We may change the Services. We may modify, rename, suspend or discontinue any feature at our discretion, with notice where the change is material.
5. Registration and Accounts
5.1 The Platform offers Free Services and Paid Services (together, "Services"). Registration is required for personalised Services.
5.2 You will hold one Account, in your real name, with accurate and current information.
5.3 Social sign-in. You may register using Google, Apple or Facebook via OAuth. You authenticate directly with that provider and we receive only the limited profile fields you approve. We never ask for, receive, or store your password for any third-party service. Your use of those services remains governed by their own terms.
5.4 Credentials. You are responsible for maintaining the confidentiality of your credentials and for all activity under your Account. Notify us immediately at support@puls-e.ai of any unauthorised use or breach.
5.5 Accuracy. If you provide information that is untrue, inaccurate, outdated or incomplete, we may suspend or terminate your Account.
5.6 Account deletion. You may delete your Account and associated data at any time in the app via Settings → Account → Delete Account. Deletion is free and requires no correspondence with us.
6. Licence
6.1 Subject to your compliance with the Policies, we grant you a limited, revocable, personal, non-exclusive, non-transferable, non-sub-licensable licence to access and use the Platform for your own personal, non-commercial use.
6.2 You must not share Account access with any other person.
6.3 All rights not expressly granted are reserved.
7. Subscriptions, fees and payment
7.1 Fees for Paid Services are as communicated on the Platform and may change on notice; changes take effect at your next renewal.
7.2 Subscriptions renew automatically for successive periods until cancelled. You may cancel at any time as set out in the Cancellation & Refund Policy.
7.3 Payment routes. Payments may be processed by: (a) Apple through in-app purchase on iOS; (b) Google through Google Play Billing on Android; or (c) Razorpay Software Private Limited for purchases on our website. Purchases made through Apple or Google are additionally governed by their terms, and refunds for those purchases are handled by them.
7.4 You warrant that: (i) you are lawfully entitled to use the payment instrument; (ii) the details you provide are accurate; and (iii) sufficient funds or credit are available.
7.5 We do not store your card, CVV, UPI or bank credentials at any time. Payment facilitation is not a banking or financial service — we are a facilitator using authorised banking and payment-gateway infrastructure.
7.6 Payments are accepted in Indian Rupees (INR) or United States Dollars (USD).
7.7 Taxes. Applicable taxes will be invoiced in addition to the fees, and you agree to pay them.
7.8 Refunds are governed exclusively by the Cancellation & Refund Policy. Except as provided there and as required by law, fees are non-refundable.
8. Acceptable use
You agree not to:
8.1 Systematically retrieve or scrape data from the Platform to build any collection, database or directory.
8.2 Trick, defraud or mislead us or other Users, or attempt to obtain another User's credentials.
8.3 Circumvent, disable or interfere with security features, or bypass restrictions on access or use.
8.4 Use information from the Platform to harass, abuse, stalk or harm any person.
8.5 Misuse support services or submit false reports of abuse or misconduct.
8.6 Use the Platform in any manner inconsistent with applicable law.
8.7 Use the Platform to advertise or sell goods or services.
8.8 Upload or transmit viruses, malware, or material that disrupts other Users' enjoyment of the Platform, including spam.
8.9 Use bots, scrapers, spiders, offline readers or any automated system to access the Platform.
8.10 Remove any copyright or proprietary notice from any Content.
8.11 Impersonate another person or use another User's account or username.
8.12 Sell, rent or transfer your Account or profile.
8.13 Interfere with, disrupt or impose an undue burden on the Platform or its networks.
8.14 Copy, adapt, decompile, disassemble or reverse-engineer any part of the Platform or its software.
8.15 Use the Platform to compete with us, or for any commercial or revenue-generating purpose.
8.16 Submit another living person's birth details for a Compatibility Reading without their consent.
9. Intellectual property
9.1 The Platform and all Content — source code, databases, functionality, software, design, text, graphics, audio, video, AI-generated content, and our astrological algorithms and engine — together with all trademarks, service marks and logos ("Marks"), are owned by or licensed to us and protected by applicable intellectual property law.
9.2 Your Readings are generated for your personal use. You may share individual Readings for personal, non-commercial purposes with attribution to Puls-E, but you may not reproduce, redistribute, resell or commercially exploit the Content or Marks without our prior written permission.
9.3 Unauthorised use may cause irreparable harm, and we reserve all remedies including injunctive relief.
9.4 Your content. You retain ownership of reflections, journal entries and messages you submit. You grant us a limited licence to process them solely to provide the Services under the Privacy Policy. We do not publish your content or use it to train third-party AI models.
10. Third-party services
10.1 The Services integrate third-party applications, including payment processors, cloud infrastructure, analytics and AI providers.
10.2 Your use of those services may be subject to their own terms, which you are responsible for reviewing.
10.3 We are not liable for third-party applications, and may suspend, restrict or remove access to any of them without notice or liability.
11. Availability
The Services may be unavailable or restricted for reasons including geographic limitations, legal restrictions, maintenance, technical faults or interruptions. We are not liable for such unavailability, subject to Clause 6 of the Cancellation & Refund Policy.
12. Disclaimers
12.1 The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
12.2 We do not warrant that the Services will be uninterrupted, timely, secure or error-free, nor that Readings will be accurate, reliable, timely or complete.
12.3 We assume no responsibility for: (a) errors or inaccuracies in content; (b) personal injury or property damage arising from use of the Services; (c) unauthorised access to our servers; (d) interruption of transmission; (e) malware transmitted by a third party; or (f) loss or damage arising from any content made available via the Services.
12.4 No advice or information obtained from us creates any warranty not expressly stated in these Terms.
13. Limitation of liability
13.1 To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special or punitive damages, or for loss of profits, business, data or goodwill, arising from your use of or inability to use the Services.
13.2 Our total aggregate liability in respect of the Services shall not exceed the total fees you paid to us in the twelve months preceding the claim.
13.3 Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any liability that cannot lawfully be excluded — including your non-waivable rights under the Consumer Protection Act, 2019 (India) and equivalent consumer protection law in your jurisdiction.
14. Indemnity
You agree to indemnify and hold harmless Puls-E, its officers, directors, employees and affiliates from any losses, damages, fines and reasonable expenses (including legal fees) arising from your breach of these Terms, your violation of law, or your infringement of a third party's rights — except where the matter arises from our own negligence or breach.
15. Force majeure
We are not liable for failure to perform where prevented by events beyond our reasonable control, including acts of God, natural disaster, war, terrorism, epidemic, government action, internet or infrastructure failure. Our obligations are suspended for the duration of such an event.
16. Suspension and termination
16.1 By you. You may terminate at any time by deleting your Account (Clause 5.6). Refund eligibility is governed by the Cancellation & Refund Policy.
16.2 By us. We may suspend or terminate your Account, with notice where practicable, if you materially breach these Terms, use the Services unlawfully, or where required by law.
16.3 Effect. On termination your licence ends and access ceases. Clauses 9, 12, 13, 14, 17 and 19 survive.
16.4 Where we terminate for material breach, no refund is due for the remaining period, save where the Cancellation & Refund Policy or applicable law requires otherwise.
17. Governing law and dispute resolution
17.1 These Terms are governed by the laws of India.
17.2 Good-faith resolution first. Please contact our Grievance Officer before commencing formal proceedings; most matters are resolved this way.
17.3 Arbitration. Any unresolved dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitrator's decision is final and binding. The seat shall be Gurugram, India, and proceedings shall be in English.
17.4 Consumer rights preserved. Nothing in Clause 17.3 prevents a consumer from approaching a Consumer Commission under the Consumer Protection Act, 2019, or from exercising any non-waivable right to bring proceedings in their place of residence.
17.5 Subject to the above, the courts of Gurugram, India have exclusive jurisdiction.
17.6 Injunctive relief. Where you breach or threaten to breach Clause 8 or 9, we may seek injunctive relief in addition to other remedies.
18. Apple and Google specific terms
These terms apply where you obtained the app from the Apple App Store or Google Play.
18.1 These Terms are between you and Puls-E only, not with Apple or Google.
18.2 Apple and Google have no obligation to provide maintenance or support for the app.
18.3 In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation and any other claims are our responsibility.
18.4 Apple and Google are not responsible for addressing any claim relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims.
18.5 In the event of a third-party claim that the app infringes intellectual property rights, we, not Apple or Google, are responsible for investigation, defence, settlement and discharge.
18.6 You represent that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government prohibited-parties list.
18.7 Apple and its subsidiaries, and Google, are third-party beneficiaries of these Terms and have the right to enforce them against you.
19. Miscellaneous
19.1 Severability. If any provision is held invalid or unenforceable, the remainder continues in full force.
19.2 No waiver. Failure to enforce a provision is not a waiver of it or of any other provision. All waivers must be in writing.
19.3 No agency. No joint venture, partnership, employment or agency relationship is created by these Terms.
19.4 Assignment. You may not assign your rights or obligations without our written consent. We may assign or subcontract, provided your rights are not diminished.
19.5 Legal process. Nothing in these Terms derogates from our right to comply with lawful law-enforcement or regulatory requests.
19.6 Entire agreement. These Terms, with the Privacy Policy and Cancellation & Refund Policy, constitute the entire agreement between you and Puls-E.
20. Grievance redressal
In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines) Rules, 2011, and the Consumer Protection (E-Commerce) Rules, 2020:
